- Placing an order
When you click on "Place Order" at the checkout, you offer to buy the Goods at the prices indicated including any delivery charges that apply to your purchase. All orders will be subject to these conditions.
- Your information
Full secure payment will be required once you have placed an order online. We require your name, e-mail address, credit / debit card details in order to process your request or notify you of acceptance of your order. We will also ask for a contact telephone number so that we may reach you if there is a problem with your order, or if your order requires a delivery quote. We may, unless you advise us otherwise, pass this information to our couriers in case they need to contact you to arrange the processing or delivery of your order. As part of our efforts to ensure that you are aware of the latest developments and offers, we may also use this information to advise you of new products, special offers or changes to our site. - Your Order
If your order has been accepted, you will be notified of this soon after you submit your order by clicking "Place Order". The confirmation is sent to you automatically, if for any reason an error occurs, please contact email@example.com. Although it is rare, errors may occur and we therefore retain the right to cancel the order and provide a full refund in accordance with our Errors Policy below. No order is binding on you or HAYGEN until we have accepted it. You will own the items we supply you from the moment they are put in the hands of the postal service, or with our carriers, or on payment in full of the price of the Goods and any delivery charge, whichever is later. Once your order has been despatched, the completion of the contract between HAYGEN and yourself takes place. Please note that we will not be able to meet any obligations as a result of the following reasons:
- If the product you ordered is out of stock
- We are unable to authorise your payment
- If it is identified that there is a product description or pricing error
- If customers do not reach any order criteria outlined in the Terms & Conditions
- If our delivery companies are temporarily unable to deliver due to exceptional conditions that are beyond our control including hazardous weather and accidents.
- Please note that if you are paying by post, on rare occasions items may sell out whilst the cheque is being cleared. Where this occurs, we will reissue a cheque for the amount.
- International Delivery
International delivery is available on certain products. Delivery is charged in accordance with the size and destination address of the order as per the delivery cost at the time of order. However, should the volumetric weight be heavier when the parcel has been parcelled up we may ask for additional funds to cover the cost of the delivery. We accept MasterCard, Visa, Switch, Solo and Delta as valid methods of payment. You confirm that the credit or debit card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.
All prices are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. The total cost of your order is the price of the products ordered plus delivery. All prices are subject to change without notice. Any customs or import duties levied once the package reaches your destination country will be your responsibility as we have no control over these charges and cannot predict them.
- Website and Catalogue Product Pricing & Descriptions
Every product bought is sold subject to its product description which outlines any further specific conditions that relate to that product including, without restriction, terms and conditions that regarding approximate delivery dates/times, warranties, after-sales support and guarantees. We undertake all reasonable care to ensure that all the details, prices and descriptions of products in our catalogues and on our website are accurate at the time when they are either entered onto our system or printed. Whilst we endeavour to keep the website as up-to-date and accurate as is possible, there may be very rare occasions when the information on the website (including product descriptions) at a certain time may not reflect the position exactly at the point an order is placed. We do not give any warranty as to the accuracy or completeness of the information and cannot be responsible for any errors or omissions or for the results arising from the use of such information. Please note that we are unable to confirm the price of a product until your order is accepted in line with our order acceptance conditions. Please also note that as computer monitors/screens vary in nature and resolution, we cannot guarantee that your monitor’s representation of any colour will be completely accurate.
- Delivery ETA & Availability
ETA dates are for guidance only and may change due to unexpected delivery problems. ETA dates reflect when deliveries are expected to arrive at our warehouse, please allow a further 7 days for stock to be quality control checked and booked in. Goods will normally be despatched within 24 hours of receipt of your order unless a different ETA date is given at product listing stage. If your order is likely to take any longer or in the unlikely event that any of the items you have ordered are out of stock, we will contact you. Delivery of made to order items depends on the supplier and we can check for the earliest delivery date and notify you. We are not liable where any delay or failure in delivery is beyond our control.
- Faulty Goods
Goods are faulty if they are received damaged or where a manufacturing fault occurs within six months of purchase; however this does not include the results of normal wear and tear. You have a statutory right to cancel your order and receive a full refund for any item or service, apart from items personalised for you. You may cancel your order by sending us a letter or e-mail cancellation at any time up to and including the seventh day (excluding Saturdays, Sundays and public holidays) after the day on which you receive your purchase. If you exercise your statutory rights to cancel you must immediately return the unwanted items following the packaging instructions in the Guarantee section below. We hope you will love your HAYGEN purchase, but if you find it unsuitable or are not entirely satisfied, provided you notify us within 7 days and return it to us within 28 days unused and in its original packaging and in perfect condition, you will be entitled to a refund or replacement. Items of furniture, mirrors and lighting can be returned only if they are unused, undamaged and in their original packaging.
Please ensure that the product is packed and labelled carefully so that it is not damaged or lost in transit as the goods are at your risk until they are returned to us. We recommend using registered post and retaining the proof of postage. Please note that we cannot refund return delivery charges unless the item you received was damaged or faulty and we have been notified of it.
- Product Guarantee:
Our products are guaranteed for 6 months. This guarantee is against faulty workmanship and/or faulty materials, with the exception of coverings. This guarantee does not cover fair wear and tear, neglect, abuse or misuse of your goods, loss or damage (including rusting and corrosion) due to unreasonable exposure to water, heat or weather; loss or damage due to fire, smoke, explosion, lighting, sunlight, infestation by animals or boring insects, or theft, or accidental damage or loss caused by third party. This does not affect your statutory 1rights. Please note that upholstery and wooden furniture is likely to fade if left in direct sunlight for prolonged periods. Double or triple glazed windows are able to slow the rate of damage caused by UV light, but we suggest keeping susceptible items away from direct sunlight. We will not be liable for any direct or indirect loss of profits or other financial loss or damage airsing out of defective, damaged or wrongly delivered goods, over and above the value of the actual goods themselves supplied by us. This does not affect your statutory rights.
In the event a HAYGEN product is listed at an incorrect price due to technical error or error in pricing information, HAYGEN shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. If your credit card has already been charged for the purchase and your order is cancelled, HAYGEN shall issue a credit to your credit card account in the amount of the incorrect price.
We do not seek to exclude or limit liability for death or personal injury arising from our negligence or that of our directors or employees or for any fraudulent misrepresentation. To the fullest extent permitted by law and save as provided above, we shall not be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence for any indirect special or consequential loss or damage (including but not limited to loss of profit or loss of saving), costs expenses or other claims for compensation whatsoever which arise out of or in connection with the use of this website, the supply of the goods or their use by you.
- Refusal of Transaction & Eligibility of Purchase
We reserve the right to withdraw any products from this Website at any time and/or remove or edit any materials or content on this Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from this Website whether or not that product has been sold; removing or editing any materials or content on the Website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun. To be eligible to purchase products on this Website and lawfully enter into and form contracts on this Website under English law you must:
- Register by providing your real name, phone number, e-mail address, payment details and other requested information
- Be over 18 years of age
- Stipulate a delivery address. Please note that PO box numbers, hotels and accommodation addresses are not acceptable
- Possess a valid credit or debit card issued by a bank acceptable to us
- Sale Item Disclaimer
We have very limited stock of our sale items, and we will not be taking back orders on any of these items. Due to the fact our stock levels are updated once every 24 hours a product may sell out during time you have placed your order and when we try to fulfil it. If this does happen we will contact you within 3 days with an alternative item or refund your money.
- Promotional Code Disclaimer
You can use published promotional codes through our website only and not in conjunction with any other offer. You can participate in offers once only. Kartell products, P&P, gift vouchers and sale items are excluded from offers. These offers are not for resale or publication and only apply to personal orders with all orders being subject to acceptance under HAYGEN standard terms and conditions - orders that are considered to be commercial may be excluded from the offer.
